Kidnap & Ransom Exclusions

Important limitations and conditions for specialist security cover.

1. General Exclusions

Criminal or Fraudulent Acts

Any criminal act, or any attempt to defraud the insurer by you, your directors, or officers (whether acting alone or in collusion with others).

Cyber Attacks

Any incident involving a cyber attack or the acts of a hacker (e.g., ransomware demands are not covered here).

Prior Events

A series of connected events where the first one began before the insurance period started.

Other Insurance

Any loss that is covered by another insurance policy (this policy only pays in excess of that other cover).

Sanctions

Any claim that would expose the insurer to sanctions under UN resolutions or the laws of the EU, UK, or USA.

Face-to-Face Surrender (Off-Premises Robbery)

The deliberate surrender of a ransom in a face-to-face encounter, unless it is being conveyed solely to pay a previously communicated ransom demand. (Note: This exclusion does not apply to a Hostage Crisis.)

On-Site Payment (On-Premises Robbery)

Paying a ransom at the location where the kidnap or extortion demand is first made, unless the demand was received before the ransom was brought to that location. (Note: This exclusion does not apply to a Hostage Crisis.)

2. Specific Exclusions by Incident Type

A. Malicious Detention — Short Duration

You are not covered for Malicious Detention if the detention lasts for a period of less than 3 hours.

A. Malicious Detention — Visa/Permit Failure

The detention results from your failure to properly procure or maintain valid immigration, work, residence, or travel visas/permits.

B. Hijack — Short Duration

You are not covered for any legal liability arising from a hijack that lasts less than 3 hours.

C. Express Kidnap

Note: The "Face-to-Face Surrender" exclusion listed in the General section above is specifically deleted for Express Kidnap claims, meaning you ARE covered if forced to withdraw money from an ATM under duress.

3. Exclusions for Political Repatriation (Section 4B)

Violation of Laws

Losses arising from your violation of the laws/regulations of the country.

Visa Issues

Failure to obtain or maintain correct immigration or work visas.

Financial Failure

Repatriation due to debt, insolvency, commercial failure, or repossession of property.

Contractual Failure

Failure to honor contractual obligations or license conditions.

Nationals

Repatriation of insured persons who are nationals of the country where the incident occurs.

Natural Disasters

Losses arising from earthquakes, floods, fire, famine, volcanic eruptions, etc. (covered under separate sections, not K&R).

Medical/Epidemic

Losses due to medical reasons, epidemics, or pandemics.

Nuclear

Nuclear reaction, radiation, or contamination.

Prior Knowledge

Events or official advice to leave that existed prior to the insurance period.
